So Saturday, my attorney, Dick, his attorney (wearing some kind of weird jogging suit from the 80’s, I swear) and the opposing expert showed up at my house. I really believe I have him out-lawyered. Seriously, a jogging suit?
I sat with my attorney at the sagging kitchen counter while they roamed all over the house, taking notes and talking. It took over three hours. They spent a lot of time looking at the beams in the loft (they are pretty twisted).
At one point, they were outside looking at the main deck on the back of the house and it seemed like they had been there for an hour, so I went over to the big windows in the back and peeked out. Dick saw me and smiled and waved this big, stupid wave. Maybe he’s finally getting exactly how much trouble this will all be for him and he’s trying to get on my good side?
When they left, my attorney took me to lunch and we discussed strategy. He thinks it might be worthwhile to file what is known as a Petition for Summary Judgment based on the fact that Dick’s attorney didn’t actually properly give notice at the beginning of the lawsuit (he was probably too busy looking at jogging suits). The risk is that it will cost a few bucks in attorney fees and filing fees. The upside is that Dick will have to pay attorney’s fees also and appear in court and if we are successful, I can start working on the house again. We decided to go for it.
