My attorney called and said that Dick was finally served yesterday! I would love to have been there when he opened the citation!
So now it becomes a waiting game. Since Dick filed first we will probably just wait until he sends us the opening round of discovery. I am also supposed to be deposed sometime soon. Dick’s attorney gets to ask me anything he wants to. Quite frankly, I can’t wait! In this type of lawsuit each side sends a list of questions and demands to the other and that can go through several rounds. In the meantime, each party is deposed, asked questions by the other party’s attorney with a court reporter in the room. The legal term for it is “Discovery”. The hope is that at some point one party or the other will back down. I can tell you one thing, it won’t be me who backs down!
I can’t work on the house at this point which is frustrating to say the least. I can, however, start working on the questions I want to ask him which will be fun. I wonder if I can ask something like, “what the heck were you thinking, you idiot?” Probably not.
It’s actually exciting, especially since I know quite a bit about the process and he knows nothing. It’s satisfying to know he is probably racking up some serious attorney bills. I think Dick thought he could intimidate me into offering him some sort of settlement just to go away, and I might have if I hadn’t gotten the expert’s report that showed that not only did he not finish the house, what he did do was pretty shoddy work.
At any rate, it is so beautiful up here right now that I don’t care about any of it. I love sitting on the deck at night and watching the deer play. I take a glass of wine out there most evenings after work and just marvel at how beautiful it all is.
I’ll report back in as soon as my deposition is done – it may be as early as next week!
